These Terms of Service ("Terms") govern your access to and use of DrakaLabs Workspace (the "Service"), provided by DrakaLabs ("we", "us", "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is provided to you through your organisation (for example, your university or employer), which administers your account. Your organisation's own policies also apply to your use of the Service.
1. Accounts and access
- Employee accounts are created by an administrator and are accessed with a staff ID and a PIN. External/guest accounts are accessed by phone one-time code or email magic link.
- You are responsible for keeping your PIN, codes, and devices confidential and for all activity under your account.
- First sign-in from a new device requires activation via a one-time code.
- After repeated failed sign-in attempts your account may be locked; contact an administrator to unlock it.
- You must provide accurate information and keep your profile details current.
- Access may be provisioned with an expiry date (for guests) or revoked at any time by an administrator.
2. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, harassing, defamatory, or abusive purposes.
- Post or transmit content that infringes others' rights, or that is malicious (for example malware).
- Attempt to bypass authentication, moderation, access controls, or rate limits, or to access accounts, data, or conversations you are not authorised to view.
- Attempt to disrupt, overload, or reverse engineer the Service except to the extent permitted by applicable law.
- Share credentials or impersonate another person or entity.
- Use the Service to exfiltrate data or circumvent your organisation's policies.
Your organisation may impose additional acceptable-use rules.
3. Your content
- "Content" means messages, files, images, calendar events, profile details, and other materials you submit.
- As between you and DrakaLabs, you (and/or your organisation) retain ownership of your Content. You grant us the rights necessary to host, process, transmit, store, back up, moderate, and display your Content to operate the Service.
- You are responsible for your Content and for having the rights to submit it.
- Your organisation controls and may access your Content in the workspace (see Section 5 and the Privacy Policy).
4. Automated moderation
- Messages are automatically screened before delivery. A message may be delivered, held for review, flagged, or withheld under the workspace communication policy.
- If a message is withheld, it is not delivered to recipients; the sender sees a brief notice. Moderation decisions do not disclose their specific reason, category, or score.
- Administrators may release or uphold held or withheld messages, and you may appeal a decision. Moderation is provided on a best-effort basis and may not catch all policy violations, and may occasionally act on legitimate content.
5. Administrator rights and oversight
- The Service is an organisational tool. Authorised administrators may manage users, groups, roles, and calendar events, and may review moderation queues and appeals.
- Authorised administrators may, where permitted, browse conversations and read message transcripts, including private direct messages. Such transcript access is logged in an audit trail.
- You acknowledge that Content in the Service is not private from your organisation's authorised administrators, and that your use is subject to your organisation's oversight and policies.
6. Service changes and availability
- We may add, change, suspend, or discontinue features at any time.
- The Service may be unavailable from time to time due to maintenance, updates, or events beyond our control. Real-time delivery is provided on a best-effort basis; message ordering and synchronisation are based on server-assigned sequence numbers.
7. Third-party services
The Service relies on third-party infrastructure (such as cloud hosting, media storage/delivery, email delivery, an automated moderation service, and, where configured, push notifications). Your use may be subject to those providers' terms. We are not responsible for third-party services we do not control.
8. Suspension and termination
- Your organisation or DrakaLabs may suspend, deactivate, or terminate your access at any time, including for violation of these Terms or organisational policy.
- Deactivation revokes your access and hides you from the directory; message history and audit records may be retained (see the Privacy Policy).
- Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and governing law) will survive.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that moderation will detect all prohibited content.
10. Limitation of liability
To the maximum extent permitted by law, DrakaLabs and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts, if any, paid for the Service in the twelve months preceding the claim, or the minimum amount permitted by applicable law.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless DrakaLabs from claims, damages, and expenses arising from your Content or your violation of these Terms or applicable law.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which DrakaLabs operates, without regard to conflict-of-laws rules. Disputes will be subject to the courts of that jurisdiction, unless your organisation's agreement specifies otherwise. [Specify the governing jurisdiction before publication.]
13. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by your organisation. Continued use after an update constitutes acceptance of the revised Terms.
